Terms of Service

1. Acceptance of Terms

By accessing or using WA Blaster AI (“the Service”, “we”, “us”), you (“the Customer”, “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all subscription tiers, including monthly and annual plans, and to any individuals you authorize to use the Service under your account.

2. Description of Service

WA Blaster AI provides WhatsApp messaging automation tools, including but not limited to: automated message sending, AI-generated message personalization, reply tracking, and related dashboard/reporting features.

The Service connects to WhatsApp messaging infrastructure to deliver these features. The Service is provided on an “as available” basis and functionality may be updated, modified, or changed at our discretion to maintain quality and reliability.

3. Subscription, Billing & Payment

• First Trial Plan: RM499 per month, billed monthly, cancel anytime before the next billing date.
• Annual Plan: RM9,999 per year, billed annually, includes onboarding and team training as described on our pricing page.
• All fees are quoted in Malaysian Ringgit (RM) and are exclusive of applicable taxes unless stated otherwise.
• Subscriptions renew automatically at the end of each billing cycle unless cancelled prior to renewal.
• Fees already paid are non-refundable except where required by law or expressly stated otherwise by us in writing.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree that:

• You will only send messages to contacts who have given consent to be contacted by you or your business, in accordance with the Malaysian Personal Data Protection Act 2010 (PDPA) and any other applicable law.
• You will not use the Service to send unsolicited spam, fraudulent content, harassment, or any content that violates the rights of any third party.
• You are solely responsible for the content of messages sent through your account and for the accuracy and legality of your contact lists.
• You will not attempt to reverse-engineer, resell, or misuse the underlying technology of the Service without our written consent.

We reserve the right to suspend or terminate accounts found to be in violation of this Acceptable Use policy, without refund.

5. Platform Risk Disclosure

WA Blaster AI is an independent service and is not officially affiliated with, endorsed by, or a certified partner of WhatsApp Inc. or Meta Platforms, Inc.

The Service operates using WhatsApp’s personal messaging infrastructure. As with any service that automates messaging on a third-party platform, your WhatsApp account’s status, functionality, and continued access remain fully subject to WhatsApp’s own terms of service, policies, and enforcement decisions, which are outside of our control.

While we implement account health safeguards designed to support stable, long-term account operation, we cannot guarantee that any WhatsApp account will remain free from restriction, limitation, or suspension by WhatsApp at any time. By using the Service, you acknowledge and accept this inherent risk of using automated messaging tools on any third-party messaging platform.

6. Limitation of Liability

To the maximum extent permitted by law, WA Blaster AI and its operators shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of business, loss of leads, loss of data, or account restrictions imposed by WhatsApp or any third-party platform, arising from your use of the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total fees paid by you in the three (3) months preceding the claim.

7. Data & Privacy

We process contact data you upload solely for the purpose of delivering the Service to you. You represent and warrant that you have the necessary rights and consents to share this data with us for this purpose.

We do not sell your contact data to third parties. Data handling practices are subject to our Privacy Policy, available on request.

8. Intellectual Property

All software, workflows, designs, and underlying technology used to deliver the Service remain the exclusive property of WA Blaster AI. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service for your business purposes only, for the duration of your active subscription.

9. Termination

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing cycle. We reserve the right to suspend or terminate any account that violates these Terms, engages in abusive behavior toward our team, or poses a risk to the stability of the Service for other customers.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service or applicable law. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. Material changes will be communicated to active subscribers where reasonably practicable.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
